Why Can It Still Fail Compliance?

A laboratory report can say “pass” while your product still has a compliance problem.

That sounds contradictory.

However, laboratory testing and regulatory compliance answer different questions.

A laboratory test asks whether a product meets a defined analytical requirement under specific test conditions.

Compliance asks whether the entire product meets all applicable legal requirements.

That can include the formula, ingredients, limits, labelling, claims, documentation, manufacturing process and intended use.

So a successful laboratory result is important.

But it is only one piece of the compliance puzzle.

A passing test does not equal a compliant product

Imagine a food supplement that passes its microbiological testing.

The result is good.

However, the product could still have an issue with its labelling, an unauthorised ingredient, a nutrition claim or another regulatory requirement.

The same principle applies to cosmetics, medical devices, food and consumer products.

A test result answers a specific analytical question.

Compliance covers the whole product.

Makrolife therefore combines analytical testing with regulatory assessment and documentation rather than treating laboratory results as the complete compliance assessment. Makrolife Biotech

What does a laboratory test actually prove?

Every laboratory test has a defined scope.

For example, a test may determine:

the concentration of an active ingredient

microbiological quality

heavy metals

pesticide residues

PFAS

migration from packaging

stability

a specific contaminant

The result tells you something about that parameter.

It does not automatically confirm everything else about the product.

Therefore, the first question should always be:

What requirement was this test designed to verify?

Compliance has several layers

A compliant product usually needs more than one successful test.

Depending on the product category, you may need to assess:

Ingredients

Are all substances permitted for the intended use?

Concentrations

Are restricted substances below the applicable limits?

Manufacturing

Does the production process meet the relevant requirements?

Labelling

Does the packaging contain the required information?

Claims

Are marketing and health claims legally permitted and adequately supported?

Safety

Has the relevant safety assessment been completed?

Documentation

Can you demonstrate compliance if an authority or customer asks for evidence?

A laboratory result only addresses the parts that were actually tested.

Example: a cosmetic product

Suppose a cosmetic cream passes:

microbiological testing

and

stability testing.

That is valuable information.

However, the product can still require a broader regulatory assessment.

Under Regulation (EC) No 1223/2009, a cosmetic product placed on the EU market must undergo a safety assessment, and the Responsible Person must maintain a Product Information File containing the required information. Public Health

The product therefore needs more than a laboratory certificate.

It needs a complete compliance framework.

Example: a food supplement

Imagine a supplement that passes an ingredient-content test.

The analytical result confirms the measured amount under the applicable method.

Yet the company may still need to check:

whether the ingredient is permitted

whether the formulation meets applicable requirements

whether the label is compliant

whether claims are authorised

whether required warnings are present

EU rules for food supplements cover, among other things, permitted vitamins and minerals and their sources, while EU food information rules also regulate mandatory information and nutrition declarations. Food Safety

So again:

A good analytical result does not automatically make the product legally marketable.

A test can also be correct but irrelevant

This is an easy mistake to make.

A company may have a perfectly valid laboratory report.

The problem is that it tested the wrong parameter.

For example, a supplier may provide a test for the active ingredient concentration.

That does not necessarily address:

contaminants

impurities

allergens

migration

microbiological quality

restricted substances

The result can be scientifically correct and still fail to answer the regulatory question.

That is why test selection should come before testing.

The test method matters

The analytical method is also part of the evidence.

Different methods can have different:

detection limits

quantification limits

selectivity

precision

accuracy

scopes

For official food controls, EU rules establish a hierarchy for analytical methods, including relevant Union methods and, where these are unavailable, internationally recognised or appropriately validated methods. Food Safety

Therefore, the question is not simply:

“Was the product tested?”

A better question is:

“Was it tested with an appropriate method for the requirement we need to demonstrate?”

Passing below a limit is not the same as proving zero

This matters particularly for trace contaminants.

Suppose the regulatory limit for a substance is:

100 µg/kg

and the laboratory reports:

<10 µg/kg.

That result may provide strong evidence that the product is below the regulatory limit.

However, it does not mean that the substance is completely absent.

The laboratory result needs to be interpreted according to the method’s reporting capability.

This distinction becomes especially important when regulatory limits are close to analytical detection or quantification limits.

What happens when the specification is wrong?

A product can also pass its internal specification while still failing a legal requirement.

Imagine a company defines its internal limit for a contaminant as:

≤ 100 mg/kg

But the applicable legal limit is:

≤ 50 mg/kg.

The product can pass the company’s specification.

It can still be non-compliant.

This is why specifications should be connected to the current regulatory requirements.

Makrolife’s compliance services specifically include product and specification assessments against applicable regulations and standards. Makrolife Biotech

Supplier documentation is not the whole story

A Certificate of Analysis can be extremely useful.

However, a supplier’s COA normally relates to a defined batch and defined parameters.

It does not automatically demonstrate that the finished product complies with every applicable requirement.

For example, a raw material COA may confirm:

purity: 99.5%

That does not necessarily answer:

Is the finished product correctly labelled?

Are the final concentrations compliant?

Are all required contaminants controlled?

Are the product claims permitted?

The COA is evidence.

It is not a complete regulatory assessment.

Formula changes can invalidate old conclusions

Another common problem appears after formulation changes.

A company may have a test report for Formula A.

Then the company changes:

an active ingredient

preservative

fragrance

excipient

concentration

supplier

packaging

The old report may still be useful.

However, it cannot automatically be assumed to represent the new product.

The relevance of existing evidence needs to be reassessed after significant changes.

Packaging can create a separate compliance question

The product itself can pass testing while its packaging creates another issue.

For food-contact materials, for example, testing can include migration of substances from packaging into food.

Makrolife’s food-contact testing portfolio includes migration testing as well as analyses for substances such as BPA, PFAS, phthalates, heavy metals and mineral oil hydrocarbons. Makrolife Biotech

Therefore, product compliance may involve both:

What is inside the product?

and

What can migrate into it from the packaging?

These are different analytical questions.

Claims are another potential failure point

A product can be analytically correct and still have problematic marketing claims.

Consider a supplement that contains exactly the declared amount of an ingredient.

The laboratory result supports the composition.

However, a health claim on the packaging still needs to comply with the applicable rules.

In the EU, nutrition and health claims are regulated separately from the analytical measurement of the product.

So:

correct composition ≠ automatically compliant marketing claim

The laboratory provides evidence about the product.

Regulatory assessment determines whether that evidence supports the way the product is marketed.

Safety and compliance are connected, but not identical

A safety assessment considers whether a product can be used safely under its intended conditions.

Compliance goes further.

It asks whether the product meets the full set of requirements applicable to its category.

That can include:

safety

composition

labelling

claims

documentation

manufacturing

market-specific requirements

Consequently, a product can have reassuring laboratory data while still requiring additional regulatory work.

Medical devices show the same principle

For medical devices, laboratory testing can provide evidence about biological, chemical or mechanical properties.

However, conformity assessment involves much more than individual test results.

Technical documentation, risk management, applicable standards and conformity requirements all form part of the broader process.

Makrolife provides biological, chemical and microbiological testing for medical-device safety and conformity assessments, alongside regulatory and documentation support. Makrolife Biotech

Again, the test is evidence within the assessment, not the assessment itself.

The same applies to stability testing

Suppose a product passes an initial stability test.

That is useful.

However, stability data need to be interpreted in relation to:

intended shelf life

storage conditions

packaging

product specifications

relevant quality attributes

A product that remains stable for three months under one condition does not automatically have a validated shelf life of three years.

The study design has to support the conclusion being made.

Makrolife offers stability and compatibility studies for pharmaceutical and cosmetic products as part of its testing portfolio. Makrolife Biotech

What does a regulator actually want to see?

A regulator does not normally ask only:

“Did the product pass a laboratory test?”

The broader question is:

“Can you demonstrate that this product complies with the requirements that apply to it?”

That requires a chain of evidence.

For example:

Requirement

↓

Risk assessment

↓

Test or study

↓

Result

↓

Interpretation

↓

Documentation

↓

Compliance decision

If one part is missing, the evidence chain can become weak.

This is why documentation matters

A good test result has limited value if nobody can explain:

why the test was performed

which requirement it addresses

which method was used

which sample was tested

whether the sample represents the marketed product

how the result was interpreted

Compliance therefore depends not only on generating data.

It depends on connecting the data to the regulatory requirement.

Makrolife explicitly positions its analytical and regulatory services around this connection, describing testing and studies as the evidence base for conformity and audit-ready documentation. Makrolife Biotech

A better way to plan product testing

Instead of starting with:

“Which tests should we order?”

start with:

“Which requirements do we need to demonstrate?”

Then work backwards.

Step 1: Identify the product category

Is it a cosmetic, food, supplement, medical device, pharmaceutical product or consumer product?

Step 2: Identify the applicable requirements

Determine the relevant regulations, standards and specifications.

Step 3: Identify the risks

Which contaminants, ingredients, claims or product characteristics require evidence?

Step 4: Select the analytical methods

Choose methods that actually answer those questions.

Step 5: Define acceptance criteria

Know what result would be considered compliant before the test starts.

Step 6: Document the conclusion

Connect the result to the applicable requirement.

This approach makes testing much more useful.

What if a product passes one test but fails another?

That is not necessarily a contradiction.

A product can pass:

microbiological testing

while failing:

heavy-metal limits.

It can pass:

active-content testing

while failing:

labelling requirements.

It can pass:

migration testing

while failing:

a claim assessment.

Each test answers a different question.

Therefore, compliance should be viewed as a set of requirements, not a single pass/fail number.

The most common mistake

The biggest mistake is treating the laboratory report as the final compliance document.

It is not.

A laboratory report tells you what was measured and what the result was.

A compliance assessment determines whether that evidence, together with the rest of the product information, demonstrates conformity with the applicable requirements.

Those two functions need to work together.

When a passing test is actually good news

None of this makes laboratory testing less valuable.

Quite the opposite.

A reliable test result can provide critical evidence.

It can confirm that:

a specification is met

a contaminant is below a limit

an ingredient is present at the expected level

a product remains stable

packaging does not exceed migration limits

microbiological quality is controlled

The important part is knowing what that result proves and what it does not prove.

The Makrolife approach

Makrolife combines analytical testing with regulatory strategy, conformity assessment and technical documentation across several product categories.

Its current portfolio covers food and supplements, cosmetics, pharmaceuticals, medical devices, food-contact materials and consumer products, among others. Makrolife Biotech

This integrated approach addresses the gap between:

“The laboratory says pass.”

and

“The product is ready for the market.”

The first is an analytical conclusion.

The second requires a broader regulatory assessment.

The bottom line

A product can pass a laboratory test and still fail compliance because testing and compliance are not the same thing.

A laboratory test answers a defined analytical question.

Compliance requires the entire product to meet the applicable requirements.

That can include:

ingredients

concentrations

contaminants

manufacturing

labelling

claims

safety

documentation

and market-specific requirements.

The strongest approach is therefore not to test first and ask regulatory questions later.

Instead:

define the requirements → identify the risks → choose the right tests → interpret the results → document the compliance decision.

A passing laboratory result is valuable.

But the real goal is not simply to pass the test.

It is to have evidence that supports a compliant product.

Your product passed the laboratory test, but can it still fail compliance?
